In November of 2008, the DOL issued revised regulations for FMLA, which covers employers with 50 or more employees. On September 25, 2009, BOLI finally issued proposed new regulations for administering OFLA leave in light of the regulations issued in 2008. Unfortunately, the proposed regulations make little attempt to harmonize the procedures employers must follow under both FMLA and OFLA.
