Description:
Revised regulations issued in 2008 under the Family and Medical Leave Act (FMLA) provided new leave entitlements for employees with family members in the reserve components of the military. Under these new provisions, employees may take up to 12 weeks of leave for a qualified exigency and up to 26 weeks of leave to care for a family member who was injured in the line of duty. A new federal bill recently expanded on these leave entitlements to allow leave for the family members of full-time military members. The bill also allows employees to take leave to care for certain injured veterans. In addition, last summer the Oregon legislature added additional leave rights under the Oregon Family Leave Act (OFLA) for employees whose family members are deployed in the armed forces. In light of these changes, the pdf below provides an overview of the expanded leave entitlements under both laws for employees with family members in the military.
