The Department of Health and Human Services has issued regulations addressing the obligation of group health plans and other entities covered by the HIPAA Privacy Rule to notify the HHS and affected individuals of any breach of the confidentiality of unsecured protected health information. These new regulations also substantially increase the penalties for the failure to comply with the HIPAA Privacy Rule, which makes it even more important for sponsors of group health plans to understand the law.
