Description:
The Children's Health Insurance Program Reauthorization Act of 2009 ("CHIPRA") requires an employer that sponsors a group health plan to provide to employees residing in a state that offers health plan premium assistance for enrolled children a notice of the availability of the premium assistance. An employer that fails to comply with this notice requirement may be assessed a penalty of $100 per day. The Department of Labor has now issued guidance regarding this new employer notice obligation.
